The victim was a passenger in a motor car being driven by the defendant in the evening. The car left the road and plunged into a ditch of water. In total darkness, the claimant was able to climb out of the vehicle, but was unable to climb out of the ditch.
The lady was rescued two and half hours later by a fire brigade and ambulance crews. She suffered various soft tissue injuries in the accident but the significant injury was the development of post-traumatic stress disorder.
