Simply-Docs Comments on Workplace Employment Law Changes

London, United Kingdom (3rd September, 2013) – Simply-Docs, a specialist provider of professionally-drafted business contracts and legal document templates, has commented on recent changes to employment law covering employment tribunal fees, settlement agreements and pre-termination negotiations.

The first change, which came into effect on 29th July 2013, states that a fee must be paid by anyone who issues a claim against their employer in an employment tribunal. There will be an initial fee and then a further fee if the claim goes to a hearing. There will be two types of claim depending on the nature of the case, and if the claim is successful then the tribunal may order the fees to be repaid to the claimant.

The second change, based around new statutory provisions, states that both the employer and employee will be unable to refer to pre-termination negotiations in their evidence, in regards to unfair dismissal claims. If an agreement is reached in pre-termination negotiations, this will from now on be referred to as a settlement agreement (previously known as ‘compromise agreements’). These agreements will allow employers to offer mutually-agreed compensation to an employee where the relationship has broken down irredeemably.

Iain Mackintosh of Simply-Docs said of the changes: ““The employment law changes which took effect on 29th July 2013 primarily affect businesses in two ways: fees must now be paid to the Employment Appeal Tribunal if challenging a successful claim, and the new settlement agreement rules will prevent employers and employees from referring to pre-termination negotiations in their evidence in relation to unfair dismissal claims.”
